1. Acceptance of Terms

By accessing or using the BuilderLync platform, website, or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our Services. These Terms constitute a legally binding agreement between you and BuilderLync Inc., a company incorporated in the State of Florida.

2. Description of Services

BuilderLync provides a cloud-based CRM and business management platform designed for roofing and exterior contractors. Our Services include, but are not limited to, customer relationship management, estimating, proposal generation, crew scheduling, invoicing, marketing automation, and AI-powered lead nurturing. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. Account Registration

To use our Services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring all users added to your account comply with these Terms

4. Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as expressly stated in these Terms or required by law. We may change our pricing with 30 days’ notice. Failure to pay may result in suspension or termination of your account.

5. Intellectual Property

The Services, including all software, designs, text, graphics, and other content, are owned by BuilderLync Inc. and protected by intellectual property laws. You retain ownership of your data. By using the Services, you grant us a limited license to use, process, and store your data solely to provide the Services. We do not claim ownership of your content.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the Services
• Reverse engineer, decompile, or disassemble the software
• Use the Services to send unsolicited marketing communications (spam)

7. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting support. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will provide a reasonable period for you to export your data.

8. Limitation of Liability

To the maximum extent permitted by law, BuilderLync Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or relating to these Terms or the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
